New York divorce law requires a fair and equitable division of marital property, including real estate, personal property, bank accounts, investments, businesses, and debts. The court considers factors such as length of marriage, income and earning capacity, age and health, contributions to the marriage, New York Divorce Law Marital Property value, and debts and liabilities. There are two types of property division: equitable distribution and separate property. Prenuptial agreements can also affect property division.
